Program overview
This disclosure describes the telephone, text message (SMS/MMS), and email communications you may receive from VIO CHIMNEY (“we,” “us,” “our”) and from the Service Professional matched to your request when you provide a phone number or email address through viochimney.com or its associated forms and phone lines (the “Platform”), and it describes exactly what you consent to when you check a consent box or otherwise opt in. It is designed to comply with the Telephone Consumer Protection Act (TCPA), Federal Communications Commission rules, and applicable state telemarketing laws, and should be read together with our Privacy Policy and Terms of Use.
This program covers messages sent by VIO CHIMNEY and messages your matched Service Professional sends about your request under the consent you gave on our form. A Service Professional that obtains its own, separate consent from you — for example, on its own paperwork or website — operates under that consent and its own policies, not this disclosure.
What you are consenting to
When you check the consent box on a service request form (or give consent verbally on a call where we announce that consent will be recorded), you provide your express consent for VIO CHIMNEY and the Service Professional matched to your request to contact you at the telephone number and email address you provided — including by live calls, text messages (SMS and MMS), prerecorded or artificial voice messages, and calls or texts placed using an automatic telephone dialing system or other automated technology — about your service request and related service matters.
Two kinds of messages exist under this program, and they are treated differently. Transactional and service-related messages relate directly to a request you made: request confirmations, matching updates, contact attempts from your matched Service Professional, scheduling and appointment reminders, estimate follow-ups, and post-service follow-up on that request. Marketing messages — such as offers, promotions, or seasonal maintenance reminders unrelated to an active request — are sent by VIO CHIMNEY only where you have separately provided express written consent to receive them (for example, by checking a distinct marketing checkbox), as required by law.
Your consent applies to the number you provided, even if you are later reassigned a new number or you provide a mobile number that replaces a landline. By opting in, you confirm that you are the subscriber or customary user of the number provided, that you are at least 18 years old, and that you are authorized to consent to communications at that number.
Consent is not a condition of purchase
CONSENT TO RECEIVE MARKETING CALLS OR TEXTS — INCLUDING ANY CALLS OR TEXTS PLACED USING AN AUTODIALER OR A PRERECORDED OR ARTIFICIAL VOICE — IS NOT A CONDITION OF PURCHASING ANY PROPERTY, GOODS, OR SERVICES, AND IS NOT REQUIRED TO SUBMIT A SERVICE REQUEST OR TO BE MATCHED WITH A SERVICE PROFESSIONAL.
If you prefer not to receive automated messages at all, you can still use the Platform: call any telephone number listed on the Platform and a person will take your request, or note your contact preferences when you speak with us or your matched Service Professional.
Message frequency, and message and data rates
Message frequency varies. For transactional messages, the number of messages depends on the activity on your request — typically a confirmation, one or more contact and scheduling messages, and follow-ups until the request is resolved. If you separately enroll in marketing messages, those are recurring and their cadence will be described at enrollment.
Message and data rates may apply to every text message sent and received, as determined by your mobile carrier and rate plan. VIO CHIMNEY does not charge for text messages, but your carrier's standard charges apply and are your responsibility.
Voice calls, calling hours, and Do Not Call
Voice calls under this program follow telemarketing law. Marketing calls are placed only with the consent the law requires for the technology used, only between 8:00 a.m. and 9:00 p.m. local time at your location, and not to numbers we know to be on the National Do Not Call Registry unless a recognized exception applies (such as your express consent or an established business relationship). Transactional calls about a request you initiated are not telemarketing, but we honor your stated contact preferences for those calls as well.
We maintain an internal do-not-call list. Telling any VIO CHIMNEY representative that you do not want further calls, or emailing legal@viochimney.com with your number and “Do Not Call” in the subject line, places your number on that list, and we will honor the request within the period required by law. Our network agreements require Service Professionals to honor equivalent requests you make to them for their own calls.
How to stop messages (STOP) and every other way to revoke consent
Text messages. Reply STOP to any text message from us to cancel further texts. We also honor the keywords STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, and OPTOUT, as well as any other message that reasonably communicates that you want messages to stop. After you text STOP, you may receive a single final message confirming that your opt-out has been processed, as permitted by law; after that, no further texts will be sent to that number under the program you opted out of unless you re-subscribe.
Other reasonable methods. You may also revoke consent — for calls, texts, or both — through any reasonable method, including emailing legal@viochimney.com with the phone number you want removed, telling any VIO CHIMNEY representative on a call, using an unsubscribe link in an email, or replying to a message with your request. We will honor revocations promptly, and in any event within the period required by applicable law after receipt. Messages already queued when you revoke may still arrive during processing.
Scope of opt-out. Opting out applies to the phone number from which you opt out (or that you identify). If you opt out of marketing messages only, you may continue to receive transactional messages about an active service request; if you revoke all consent, we and your matched Service Professional will stop automated calls and texts to that number, which may require us to handle your active request by other means (such as manually dialed calls or email). Opting out does not cancel an active service request, and you may opt back in at any time by submitting a new consent.

Reply HELP to any text message from us to receive assistance and contact information, or email legal@viochimney.com with “SMS Help” in the subject line. We will respond with information about the program, how to stop messages, and how to reach us.
Carriers and delivery
Text messages are delivered over networks we do not control. Wireless carriers are not liable for delayed or undelivered messages, and neither VIO CHIMNEY nor any Service Professional is responsible for delays, failures, or errors in delivery caused by carriers, network congestion, coverage gaps, device settings, or other factors outside our reasonable control. The program is available on major U.S. carriers; supported carriers may change without notice. Do not read or respond to messages while driving.
If your phone number changes
You agree to notify us promptly at legal@viochimney.com (or by any method above) if you relinquish, port, or change the phone number you provided, so that messages intended for you are not sent to a number reassigned to someone else. Until you notify us or we otherwise learn of the change through reassigned-number safeguards, communications sent to the number you provided are deemed directed to you.
Proof of consent and our records
We keep records sufficient to document your consent and your choices — such as the date and time of your submission, the form and the consent language presented to you, the phone number and other details you entered, and subsequent opt-outs or revocations — as required or permitted by law. These records are handled in accordance with our Privacy Policy and are used to honor your preferences, to route communications correctly, and to demonstrate compliance with the TCPA and related laws.
Privacy of your opt-in information
Our Privacy Policy explains how we collect, use, and protect the contact information used for this program. In keeping with industry messaging standards: mobile opt-in data and consent for text messaging are not shared with or sold to third parties or affiliates for their own marketing or promotional purposes. Your number is shared with the Service Professional matched to your request so it can contact you about that request, and with the communications vendors that deliver messages on our behalf, as described in the Privacy Policy.
Calls with us may be monitored or recorded for quality, training, and record-keeping where permitted by law, with disclosure at or near the start of the call. If you do not wish to be recorded, tell the representative, and we will accommodate you where the law allows.
Changes to this program
We may update this disclosure — for example, to reflect new message types, keywords, vendors, or legal requirements — by posting the revised version with an updated Last updated date. Material changes that expand the communications you receive will not take effect for you without any new consent that applicable law requires. Your continued participation in the program after non-material changes constitutes acceptance of them.
